# Non-paying tenant in Barcelona: sell or wait

When a tenant stops paying in Barcelona, the choice is not only sell or wait. First you document, give notice, and weigh negotiation, insurance, a rent claim, or eviction for non-payment; then you compare the cost of waiting with an occupied sale under conflict.

When a tenant stops paying in Barcelona, the question I get is almost always binary: sell now, or wait until the flat is empty again? It usually arrives late. You still need communication, paperwork, a certified demand, and, if needed, a rent claim or eviction for non-payment under Spanish civil procedure. Only then can you honestly weigh the cash cost of waiting against an occupied sale under conflict.

This page is not individual legal advice. It does not replace your lawyer or your court agent (procurador). The procedural frame is the [Civil Procedure Act (LEC)](https://www.boe.es/buscar/act.php?id=BOE-A-2000-323). I am not telling you what to do with your specific flat in Eixample, Gràcia, Sant Martí, Ciutat Vella, or Sarrià-Sant Gervasi. Bring the contract, bank statements, and the history of notices; without those there are only diagrams. I also do not cover illegal occupation without a title: that is a different procedural track. And do not change the locks or cut utilities to “speed things up”.

Warning

Taking possession back by force (changing locks, cutting power or water, entering without a title) can make your position worse. Eviction for non-payment runs through the court. A key-handover agreement only helps if it is documented.

## [What non-payment already underway actually means](https://pedroochoa.com/en/blog/non-paying-tenant-barcelona-sell-or-wait-2026/#what-non-payment-already-underway-actually-means)

Article 27.2.a) of the LAU lets the landlord terminate the contract by operation of law for unpaid rent or for any other sums the tenant agreed to pay or must pay. That is what the consolidated [Urban Leases Act](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) says. You do not need a magic number of missed months; the statute does not fix one there. What you do need is proof: the contract, a clear statement of what is owed, and a record that the money did not arrive.

That is not the same as “tomorrow the flat is empty”. Contract termination and physical recovery (lanzamiento) run through civil procedure. The [Civil Procedure Act](https://www.boe.es/buscar/act.php?id=BOE-A-2000-323) places eviction for non-payment in the oral trial track (juicio verbal) and regulates enervation (enervación), the demand after the claim is admitted, and the option to join a claim for rent arrears. Meanwhile, the debt grows, community fees and property tax keep falling due, and the flat does not present as a clean vacant unit.

Owners often blur cases that do not deserve the same urgency. A one-off delay with a reply and a credible payment plan is one thing. Silence or repeated partial payments with no written deal is another. Open conflict (cross-complaints, blocked access, damage, or a tenant who already says they will not leave) is a third. Any of them can end in eviction for non-payment. They do not all justify the same rush to sell.

If the contract is still alive and someone is still inside, selling is not selling “square metres”. You are selling an asset with a lease and litigation risk attached. ## [First moves: communicate, document, and demand payment](https://pedroochoa.com/en/blog/non-paying-tenant-barcelona-sell-or-wait-2026/#first-moves-communicate-document-and-demand-payment)

Before you choose between selling and waiting, I address four practical fronts.

First, communication. A WhatsApp thread helps as an indication, not as complete proof. What usually matters later is a certified demand for payment: a burofax with acknowledgement, or an equivalent channel that leaves date, content, and delivery. A payment demand sent at least thirty days before the claim is one of the routes that stops ordinary enervation if the tenant still had not paid on time, under the [Civil Procedure Act](https://www.boe.es/buscar/act.php?id=BOE-A-2000-323). Your lawyer designs that procedural detail; I only flag why the burofax clock matters.

Second, the folder. Signed contract, annexes, rent updates, receipts or statements, earlier messages, community minutes if there are special assessments (including unpaid ones passed on to the tenant), and proof that the legal deposit sits with [INCASÒL](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/diposit-de-fiances). Without a folder, the lawyer improvises and a future buyer does too.

Third, the deposit (fianza). In Catalonia the landlord must lodge the legal security deposit within two months of formalisation. You apply for return of the deposit when the contract has ended or been terminated, with papers that prove that end or recovery of possession, according to the [INCASÒL return process](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/devolucio-de-fiances). The deposit is not an ATM for unpaid rent: it is a guarantee with its own rules. Fourth, private insurance or public cover, if either exists. If you bought rent-default insurance, open the claim with the papers the policy asks for and check exclusions, waiting periods, and the monthly ceiling. If the contract sits under [Avalloguer](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/avalloguer), that cover does not start with an email to the tenant: among other conditions, you must file for eviction for non-payment and meet rent, deposit, and commitment-document rules.

Note

A clear demand today often saves tomorrow’s fight about whether the tenant “did not know” the amount or could still enervate. The Civil Procedure Act ties that prior certified demand to the exclusion of ordinary enervation under article 22.4.

## [Negotiate before you litigate](https://pedroochoa.com/en/blog/non-paying-tenant-barcelona-sell-or-wait-2026/#negotiate-before-you-litigate)

Negotiate when a written deal closes the gap more cheaply than a lawsuit.

A deal that actually helps usually pins down the recognised debt, a payment or exit calendar, a key-handover date, the condition of the property, and what happens to the deposit. The lodged deposit still follows [INCASÒL](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/diposit-de-fiances) rules, so do not treat it as an informal rent advance without documenting termination. If the tenant wants to stay and pay in instalments, look at real solvency, not goodwill. If they want to leave in exchange for writing off part of the debt, compare that write-off with extra months of court-driven vacancy and with the discount a buyer would demand if you sell under conflict.

The Civil Procedure Act lets you announce, in an eviction claim for non-payment or for end of term, a commitment to forgive all or part of the debt and costs if the tenant vacates voluntarily within a period that cannot be shorter than fifteen days from service of the claim. That sits in the [Civil Procedure Act](https://www.boe.es/buscar/act.php?id=BOE-A-2000-323). It is a procedural tool, not a marketing slogan. The person who signs the claim designs it. The underlying cause remains non-payment under [article 27 of the Urban Leases Act](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003).

I do not invent mediation success rates for Barcelona or average lawyer fees. In practice, a signed deal with keys returned leaves a flat easier to sell or re-let than a half-finished file. If the deal fails, the paper trail still helps: it shows diligence.

## [Private insurance and Avalloguer: what they cover and what they do not](https://pedroochoa.com/en/blog/non-paying-tenant-barcelona-sell-or-wait-2026/#private-insurance-and-avalloguer-what-they-cover-and-what-they-do-not)

Private rent-default insurance and [Avalloguer](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/avalloguer) are not interchangeable.

Avalloguer, according to [INCASÒL](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/avalloguer), covers housing landlords with contracts under article 2 of the LAU for a set amount when they file a court eviction for non-payment and meet the scheme rules. For contracts signed from 18 June 2014 it covers up to three months’ rent; for contracts between 29 August 2008 and 17 June 2014, up to six. There are rent caps by zone (in Barcelona city, 1,500 euros a month on the published table), a duty to have lodged the deposit on time, not to have demanded any other deposit, surety or additional guarantee at signing, and to have signed the commitment document. The three- or six-month ceiling does not, in the ordinary scheme, cover arrears from before the eviction claim is filed; INCASÒL reserves that inclusion for officially protected housing in certain mediation, assignment or insertion programmes. You apply for compensation within six months of the judgment or out-of-court agreement that proves recovery of possession.

A private policy may cover more months, costs, or legal defence, or it may exclude early defaults, high rents, or missing documented tenant selection. Read the policy. Do not assume “I have insurance” means “I collect as if the tenant paid”.

Neither of these covers empties the flat the day after you report the claim. You still have the court process, physical recovery, and whatever state the property is in. The [Urban Leases Act](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) remains the contract. The [Civil Procedure Act](https://www.boe.es/buscar/act.php?id=BOE-A-2000-323) remains the route.

## [Rent claims and eviction for non-payment](https://pedroochoa.com/en/blog/non-paying-tenant-barcelona-sell-or-wait-2026/#rent-claims-and-eviction-for-non-payment)

When the amicable path is exhausted, the usual route is the oral-trial eviction for non-payment, with or without a joined claim for rent arrears, under the [Civil Procedure Act](https://www.boe.es/buscar/act.php?id=BOE-A-2000-323). The substantive cause remains [article 27.2.a) of the Urban Leases Act](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003).

After the claim is admitted, the court clerk (letrado de la Administración de Justicia) demands that the defendant, within ten days, vacate, pay, enervate by paying what is owed, or raise the limited grounds of opposition. If the defendant neither answers the demand nor opposes, the case can end by decree and move toward physical recovery on the listed date. The statute describes that path; the real calendar belongs to the court.

Ordinary enervation under article 22.4 of the Civil Procedure Act lets the tenant stop the eviction by paying or consigning, inside the demand window, the sums claimed and those then due. That is in the [Civil Procedure Act](https://www.boe.es/buscar/act.php?id=BOE-A-2000-323). It does not apply if the tenant already enervated once before (unless collection failed for a reason attributable to the landlord) or if the landlord sent a certified payment demand at least thirty days before the claim and payment still did not happen. The prior burofax is therefore not empty formality. In Spanish practice this mechanism is called enervación. It is not a US-style “cure” slogan; it sits inside the LEC oral-trial rules.

On timelines I stick to what the [CGPJ Overview of Justice 2025](https://www.poderjudicial.es/stfls/ESTADISTICA/FICHEROS/Panoramicajusticia/Panor%C3%A1mica%20de%20la%20Justicia%20-%20A%C3%B1o%202025.pdf) publishes: the estimated average duration of lease-related oral trials in Spain was 9.2 months in 2025 (8.8 in 2024). That figure is a national estimate for cases finished at first instance. It does not split how cases ended, and it does not add appeals or the physical-recovery phase in every file. It is not the timetable of your Barcelona court. Do not copy ranges from other blogs without a source. If your lawyer gives you a local calendar, that calendar outranks a national average.

Law 12/2023 adds definitions and procedural changes that can affect the claim depending on the claimant’s profile and the occupant’s. Whether you are a large landlord, what papers must travel with the claim, and how standing is framed are questions your lawyer settles against the wording in force on filing day. ## [Selling under conflict versus waiting](https://pedroochoa.com/en/blog/non-paying-tenant-barcelona-sell-or-wait-2026/#selling-under-conflict-versus-waiting)

“Waiting” is not one strategy. Sometimes it means the tenant pays and the contract continues. Sometimes it means a negotiated exit. Sometimes it means eviction and physical recovery leave the flat empty. Every path burns cash (uncollected rent, community fees, property tax, mortgage if any, possible legal costs) and opportunity (you cannot sell vacant or re-let clean).

Selling with the conflict open usually means a buyer who discounts risk: unpaid rent, litigation, unknown interior condition, date uncertainty. I do not have an official table of “percentage discount for arrears in Barcelona” and I will not invent one. The private buyer who wants to live there often disappears; an investor remains, and the investor asks for price. While the contract is unresolved, the [Urban Leases Act](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) still ties possession and rent; the buyer inherits that scenario.

The comparison needs ugly but honest numbers:

1.  Debt accumulated today and a month-by-month projection if the case continues.
2.  Estimated lawyer, court-agent, and fee costs (your counsel gives those, not a blog).
3.  Plausible months to possession on a local professional indication, checked against the national average for [lease oral trials from the CGPJ](https://www.poderjudicial.es/stfls/ESTADISTICA/FICHEROS/Panoramicajusticia/Panor%C3%A1mica%20de%20la%20Justicia%20-%20A%C3%B1o%202025.pdf).
4.  Estimated vacant sale value versus occupied-with-conflict value.
5.  Liquidity you need and how much management stress you can carry.

If the plan is to finish the eviction, the route remains the [Civil Procedure Act](https://www.boe.es/buscar/act.php?id=BOE-A-2000-323). Selling does not automatically pause that process; coordinate with counsel so you do not contradict recovery dates or settlements.

If the gap between selling now at a discount and selling vacant in X months does not cover the new debt, the legal costs, and the strain on you, selling now can be rational. If the discount eats more than the cost of finishing the procedure, waiting actively in court can be better than selling from a weak position. The contract stays under the [Urban Leases Act](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) until it is resolved. Passive waiting, with no claim and no negotiation, is usually the worst option: the debt grows and the file does not move.

## [Decision criteria I use in practice](https://pedroochoa.com/en/blog/non-paying-tenant-barcelona-sell-or-wait-2026/#decision-criteria-i-use-in-practice)

I check these against papers, not hallway instinct.

If private insurance or operable [Avalloguer](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/avalloguer) exists, the cash cost of waiting falls even if the calendar does not. Activate the cover with the real requirements, not the version you heard second-hand. For return of the lodged deposit once the contract ends, use the [INCASÒL return process](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/devolucio-de-fiances).

If the tenant answers the demand with a credible plan and guarantees exit or payment, a documented deal can be cleaner than a forced recovery. The [Civil Procedure Act](https://www.boe.es/buscar/act.php?id=BOE-A-2000-323) recognises space for forgiveness conditioned on vacating; use it with advice.

If there is total silence, the debt is growing, and there is no cover, delaying the claim usually worsens the figures. The [Urban Leases Act](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) already allows termination for non-payment; the clock is the Civil Procedure Act and the court.

If you need liquidity now and an investor’s discount is bearable next to your alternative (keep funding an asset that does not yield), selling occupied under conflict can be the least bad exit. If you can fund the procedure and the vacant-price gap is large, finishing recovery usually protects value.

If you are a large landlord or the case touches vulnerability and social services, [Law 12/2023](https://www.boe.es/buscar/act.php?id=BOE-A-2023-12203) and later doctrine can add steps or nuances. Counsel reviews that with your land-registry note and the occupant’s profile; do not settle it from a headline.

In neighbourhoods with strong private demand (parts of Eixample, Gràcia, or Sarrià-Sant Gervasi), a vacant flat usually opens a wider buyer set. In zones with a stronger investor profile (stretches of Sant Martí or Ciutat Vella, depending on the product), occupied with healthy rent is easier to understand; occupied with unpaid rent almost never is. The neighbourhood does not erase the conflict: it only changes who looks at the listing. When someone arrives with non-payment already underway, this is the work order I usually ask for:

1.  Open the folder without drama: contract, payments, deposit, insurance, messages.
2.  Certified demand with a clear statement of what is owed, aligned with what the [Civil Procedure Act](https://www.boe.es/buscar/act.php?id=BOE-A-2000-323) contemplates for enervation.
3.  Decide in seven to ten days whether there is a real margin for a written deal.
4.  If there is not, instruct counsel to file eviction for non-payment under [article 27 of the Urban Leases Act](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) and the Civil Procedure Act route, activating insurance or [Avalloguer](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/avalloguer) if either exists.
5.  In parallel, ask for two sale numbers: occupied under conflict and estimated vacant. With those two numbers and a plausible legal calendar, you choose sell now or wait actively.
