# Catalonia rent rules: what an owner should know

As of 21 September 2026 the cap still covers 271 municipalities, not 302. Separate the rule in force from the procedure, and what changes by contract, municipality, and whether you are a small owner or a large holder.

On 21 September 2026 the rent you can ask in Catalonia depends on the contract date, the municipality, and whether the landlord is a large holder. None of those three replaces the others.

The contract still rests on the [Urban Leases Act](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003). The framework for declaring a stressed residential market area, and for defining a large holder, is [Law 12/2023 on the right to housing](https://www.boe.es/buscar/act.php?id=BOE-A-2023-12203). Law 11/2025 applies throughout Catalonia and entered into force on 1 January 2026, according to the [Portal Jurídic note](https://portaljuridic.gencat.cat/ca/detalls/noticia/llei_mesures_materia_habitatge_urbanisme_dogc). The map that limits rent today is not the map of 302 municipalities. The two declarations from 2024 are still the ones in force: 140 municipalities and, in a later resolution, another 131.

Warning

A report and a public-information notice do not change the municipality where you can set the rent. Until there is a new resolution, and the ministry records it, the census that counts is the one from 2024.

## [What is in force, and what is still a procedure](https://pedroochoa.com/en/blog/new-catalonia-rental-regulation-owners-guide-2026/#what-is-in-force-and-what-is-still-a-procedure)

The [LAU](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) is still the contract. [Law 12/2023](https://www.boe.es/buscar/act.php?id=BOE-A-2023-12203) does not replace it. By its first final provision, it puts the stressed area, the large holder, the caps on a new rent, and the extraordinary extensions inside the LAU.

The Catalan statute on seasonal lets and rooms is Law 11/2025 of 29 December, published in DOGC no. 9574 of 31 December 2025. The [Portal Jurídic de Catalunya](https://portaljuridic.gencat.cat/ca/detalls/noticia/llei_mesures_materia_habitatge_urbanisme_dogc) says that it applies throughout Catalonia and that it entered into force on 1 January 2026. The text that adds articles 66 bis and 66 ter to Law 18/2007 is in the [DOGC for that law](https://www.boe.es/ccaa/dogc/2025/9574/f00001-00025.pdf). It is not a bill. It is already law.

A different Catalan piece is [Decree-law 3/2026 of 24 March](https://www.boe.es/ccaa/dogc/2026/9632/f00001-00027.pdf), published in DOGC no. 9632 of 25 March 2026. Its final provision says that it enters into force on the day after that publication, which is 26 March 2026. That decree touches advertising and the statements in the contract. It does not touch the municipal map.

What is not in force is Royal Decree-law 8/2026 of 20 March. Congress repealed it in the session of 28 April 2026. The decision is in the [resolution published in the BOE of 30 April 2026](https://www.boe.es/diario_boe/txt.php?id=BOE-A-2026-9359). While it existed, it allowed an extraordinary extension of up to two years and a 2 percent cap on the update. Repealed, it is no basis for a new extension, or for that 2 percent on a September anniversary.

What is still a procedure, and not a census in force, is the step from 271 to 302 municipalities. The [Generalitat page on stressed areas](https://habitatge.gencat.cat/ca/normativa/zones-de-mercat-residencial-tensionat/), updated on 19 August 2026 and consulted on 21 September 2026, still lists resolutions TER/800/2024 and TER/2408/2024 as declarations. The 2026 documents appear there as a start agreement, a report, and a public-information notice, with the deadline extended on 19 August. That index does not contain a declaration resolution that replaces them.

## [A signed contract is not rewritten the day the law changes](https://pedroochoa.com/en/blog/new-catalonia-rental-regulation-owners-guide-2026/#a-signed-contract-is-not-rewritten-the-day-the-law-changes)

If the apartment is already let, the date of the contract governs. Publishing a statute does not, by itself, change next month’s rent.

The minimum term is in [article 9 of the LAU](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003). If the agreed term falls short of five years, or seven when the landlord is a legal entity, the contract extends year by year up to that minimum, unless the tenant gives thirty days’ notice that they will not renew. After that minimum, [article 10.1](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) adds up to three years of tacit extension, one year at a time, if neither side has refused to renew: four months’ notice from the landlord, two from the tenant. The tenant can end each of those years on one month’s notice.

Article 10.2 adds, at most, one further year. The tenant of a habitual residence asks for it, with a social-services vulnerability certificate from the last year, and the large holder has to accept unless a new contract is already in place. That paragraph does not require a stressed area.

Article 10.3 does. When the extension under 9.1 ends, or the tacit extension under 10.1 ends, the tenant can ask for further years, up to three, on the terms of the contract in force. The landlord accepts unless the parties agreed otherwise, unless a new contract is already in place under paragraphs 6 and 7 of article 17, or unless the landlord gave notice, inside the periods in article 9.3, that they need the dwelling for themselves, for a first-degree relative, or for the spouse after a final judgment of separation, divorce, or nullity. Those periods are the ones in article 9.3.

Paragraphs 6 and 7 of article 17 govern the initial rent of a new contract. A contract already running is updated, if at all, under article 18 and its own clause. The LAU note sends earlier contracts to the transitional provision of Law 12/2023. You do not reprice a 2022 contract, under the [LAU](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003), as if it were signed today. The cap can reach you when that contract ends and you sign another.

## [Where the cap applies: 271 municipalities, not 302](https://pedroochoa.com/en/blog/new-catalonia-rental-regulation-owners-guide-2026/#where-the-cap-applies-271-municipalities-not-302)

The cap does not cover the whole of Catalonia. It covers the municipalities in a declaration that is in force and that the ministry has recorded.

The [resolution of 14 March 2024](https://www.boe.es/diario_boe/txt.php?id=BOE-A-2024-5214), published in the BOE of 15 March, records 140 municipalities. Barcelona is on that list. The term is three years from the day after publication, and the resolution takes effect from that same following day, 16 March 2024. On 21 September 2026 it is still inside those three years, which run out in March 2027.

The [resolution of 8 October 2024](https://www.boe.es/diario_boe/txt.php?id=BOE-A-2024-20576), published in the BOE of 9 October, adds 131 municipalities and sets another three years from the day after its publication. It is still in force in September 2026. 140 plus 131 is 271. In the official index consulted on 21 September 2026 there is no third state resolution that adds or removes municipalities.

If the apartment is in Eixample, Gràcia, Sant Martí, Ciutat Vella, or Sarrià-Sant Gervasi, there is no neighborhood declaration. They are districts of Barcelona, and Barcelona is one of the 140. A municipality on neither list does not enter articles 17.6 and 17.7 just because the comarca is expensive, or because a press map paints it another color.

The figure 302 is the count of an open procedure, not a census in force. The [extension report of 31 July 2026](https://habitatge.gencat.cat/web/.content/home/normativa/Zones-mercat-tensionat/20260731_Memoria_ZMRT1_PR1_ES_D_CA.pdf) concludes that 118 of the 140 still meet article 18.3 of Law 12/2023 and that 22 no longer do. Barcelona is among the 118 it proposes to extend. The [report of 30 July 2026](https://habitatge.gencat.cat/web/.content/home/normativa/Zones-mercat-tensionat/20260730_Memoria_ZMRT3_ES_D_CA.pdf) proposes declaring 53 municipalities that were not in the 2024 resolutions. 118 plus 131 plus 53 is 302. That is the proposal. It does not replace the resolutions that have been published.

The [Generalitat page](https://habitatge.gencat.cat/ca/normativa/zones-de-mercat-residencial-tensionat/) presents those documents as the start of a procedure and as public information, with the deadline extended on 19 August 2026. Article 18.2.d of [Law 12/2023](https://www.boe.es/buscar/act.php?id=BOE-A-2023-12203) sets a term of three years, requires the same procedure to extend, and charges the ministry with the quarterly list of declared zones. A new municipality is not capped on the day of the announcement. A municipality the report wants to remove stays inside while the 2024 resolution has not been replaced. I am not writing any town off the list because of a July headline.

If nobody extends it, the first declaration runs toward March 2027. The open procedure is there for that extension. Open does not mean resolved. On 21 September 2026 the published list is still the 2024 list.

## [A small owner and a large holder do not sign the same rent](https://pedroochoa.com/en/blog/new-catalonia-rental-regulation-owners-guide-2026/#a-small-owner-and-a-large-holder-do-not-sign-the-same-rent)

There is a general definition and a definition for the zone. They do not count the same things.

[Article 3.k of Law 12/2023](https://www.boe.es/buscar/act.php?id=BOE-A-2023-12203) calls a large holder, for the purposes of that law, a person who owns more than ten urban properties of residential use, or a built area of more than 1,500 square meters of residential use. Garages and storage rooms are left out. The same letter allows the threshold to be lowered, in the declaration of a zone, to five or more urban properties of residential use located in that area, if the autonomous community gives reasons.

In the 140, the [state resolution of March 2024](https://www.boe.es/diario_boe/txt.php?id=BOE-A-2024-5214) records the definition in TER/800/2024: a large holder is also a person who has five or more urban properties of residential use in the zone. The October resolution does the same for the 131. The definition of more than ten, or of more than 1,500 square meters, does not disappear. The definition of five is additional, and it only counts dwellings of residential use inside the zone, not the garage.

Five inside the list put you in that regime even if you do not reach ten in Spain. Below both thresholds, article 17.7 does not apply merely because someone calls you a large holder. A wrong count changes the rent you can write.

Catalonia also uses “gran tenedor” for pre-emption and withdrawal, under the rules in Law 18/2007. Law 11/2025 allows the Generalitat to exercise pre-emption and withdrawal on the transfer of dwellings located in a stressed area. That is not the rent cap. For a new lease, the definition that governs is the one in Law 12/2023, as the ministerial resolution for that municipality records it.

## [How the rent on a new contract is set](https://pedroochoa.com/en/blog/new-catalonia-rental-regulation-owners-guide-2026/#how-the-rent-on-a-new-contract-is-set)

In a municipality that is not on the list, [article 17.1 of the LAU](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) still says that the initial rent is whatever the parties agree. The zone cap is not imported by analogy.

Inside a zone in force, article 17.6 sets another ceiling. The new rent cannot exceed the last habitual-dwelling rent in force on that same dwelling in the previous five years, once that contract’s update clause is applied. Fees or expenses the earlier contract did not pass on to the tenant cannot be added.

Only an extra 10 percent is allowed on that rent, and only in one of the four cases in article 17.6: rehabilitation under article 41.1 of the personal income tax regulation, finished in the previous two years; a proven 30 percent saving of non-renewable primary energy, with the certificates and deadlines the provision sets out; accessibility works finished in those two years; or a contract, or an optional extension by the tenant, of ten years or more on the same terms. Outside those four, there is no 10 percent.

Article 17.7 goes further, and it says “without prejudice” to the rule above. If the landlord is a large holder and the dwelling sits in a zone in force, the initial rent cannot exceed the maximum of the reference price index system, given the dwelling and the building. The same limit applies even if you are not a large holder, when the apartment had no habitual-dwelling contract in the last five years, if the ministerial resolution recorded that. In Catalonia the [March 2024 resolution](https://www.boe.es/diario_boe/txt.php?id=BOE-A-2024-5214) and the [October 2024 resolution](https://www.boe.es/diario_boe/txt.php?id=BOE-A-2024-20576) both say that second paragraph does apply.

If there is a previous rent and you are also a large holder, both rules apply. You do not go above the updated previous rent, with the 10 percent only in one case on the list, and you do not go above the index. The figure is the lower of the two under the [LAU](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003).

That index is not the IRAV, and it is not a neighborhood average. The [resolution of 16 April 2026](https://www.boe.es/diario_boe/txt.php?id=BOE-A-2026-8691), published on 20 April and effective from the next day, updates the system for article 17.7. The limit is the upper value of the individualized range for that dwelling, by location and characteristics. Look it up on the portal named in the resolution. Do not copy it from somebody else’s listing.

[INCASÒL](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/diposit-de-fiances) asks, for habitual-dwelling contracts from 26 March 2026, that this report be attached to process the deposit. The two-month deadline still runs from contract formalization. Article 17 bars charging more than one month in advance, and [article 20 of the LAU](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) makes the landlord bear the real-estate management and contract-formalization fees.

## [How an existing rent is updated](https://pedroochoa.com/en/blog/new-catalonia-rental-regulation-owners-guide-2026/#how-an-existing-rent-is-updated)

An update means applying, once a year, the clause and the legal ceiling of that day.

[Article 18.1 of the LAU](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) allows the rent to be updated only on the date each year is completed, and only on the terms that were agreed. If there is no express agreement, there is no update. It does not matter what the CPI or the IRAV has done. Without a clause, the rent stays put.

If the agreement names no index, article 18.1 orders the Competitiveness Guarantee Index, using the latest figure published on the update date. The increase still cannot exceed the CPI of that same date. The new rent runs from the month after written notice, and the notice has to state the percentage. A note on the previous receipt is enough. Late notice does not recover the silent months.

For contracts after 26 May 2023, the [INE](https://www.ine.es/uc/oC7D0Ncd) says that the review uses the IRAV, the index that the eleventh additional provision of the LAU assigned as the limit in article 18. The IRAV for August 2026 is an annual variation of 2.47 percent, published on 15 September 2026. It is not the percentage in your contract. On the anniversary, the latest index already published on that day is the one that applies. If the anniversary was 1 September, the figure of the 15th did not exist yet.

The extraordinary 2 percent arrived with Royal Decree-law 8/2026 and was removed by the [repeal published on 30 April 2026](https://www.boe.es/diario_boe/txt.php?id=BOE-A-2026-9359). A September update does not have that 2 percent as a ceiling in force. The resolution does not say what happens to an update already collected, or to an extension already accepted, between 21 March and 30 April. I am not closing that piece here.

The IRAV and the reference price system are not interchangeable. The IRAV reviews, once a year, an existing contract that allows the review. The reference price system caps the initial rent in the article 17.7 cases. Using 2.47 percent to raise the zone index comes from neither rule. The INE page links a ministry calculator for contracts after 26 May 2023. It does not fix a badly written clause.

## [Seasonal lets and rooms are no longer a side regime](https://pedroochoa.com/en/blog/new-catalonia-rental-regulation-owners-guide-2026/#seasonal-lets-and-rooms-are-no-longer-a-side-regime)

From 1 January 2026, in Catalonia, calling a contract temporary does not take it out of habitual housing. That is what article 66 bis of Law 18/2007 says, added by [Law 11/2025](https://www.boe.es/ccaa/dogc/2025/9574/f00001-00025.pdf).

Article 66 bis treats as permanent housing a dwelling intended to meet the need for housing, however long the contract lasts. Recreational, tourist, or holiday use stays outside, and that cause has to appear on the paper. A short duration, on its own, is not enough.

If the cause is professional, for work, for studies, medical, or a provisional wait for another dwelling or for a return to the habitual residence, or if the contract sets a term and states no purpose, housing rules apply to the security deposit, guarantees, rent, updates, improvements, and expenses. The purpose has to be proved and lodged with the security deposit. If the register shows no other use, permanent housing is presumed.

Leisure or holidays are governed as use other than housing only if the cause, the documentation, and the tenant’s permanent residence are all stated, and all of that is lodged with the security deposit. [INCASÒL](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/diposit-de-fiances) asks for it, for temporary contracts formalized from 1 January 2026, as a document in the procedure.

If a temporary contract is extended without proof of the cause, and without proof that the tenant lives somewhere else, article 66 bis moves it to permanent housing, minimum duration included, counted from the initial contract. A new contract with the same person and the same dwelling also stays in permanent housing, unless it is proved that the temporary cause continues.

[Article 66 ter](https://www.boe.es/ccaa/dogc/2025/9574/f00001-00025.pdf) defines a room as the exclusive use of one room and of the common areas, within the occupancy certificate (cédula). Splitting the apartment does not set the housing rules aside. In a stressed area, the sum of the simultaneous rents cannot exceed the maximum rent of the unitary lease.

Four room contracts in a zone in force cannot add up to more than the unitary rent. If the real cause is living there, article 66 bis treats the contract as permanent housing even if the heading says seasonal. A properly documented holiday let, or a room that fits the occupancy certificate, can still be done. An eleven-month seasonal contract for someone who will live there, with no papers for the cause, cannot.

## [Security deposit, the listing, and the March decree](https://pedroochoa.com/en/blog/new-catalonia-rental-regulation-owners-guide-2026/#security-deposit-the-listing-and-the-march-decree)

[Article 36.1 of the LAU](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) requires a cash security deposit: one month’s rent for housing, and two for use other than housing. During the first five years, or seven if the landlord is a legal entity, it is not updated. On each extension, the landlord can ask that it be brought into line with one or two months of the rent then in force. The additional guarantee, during those same housing periods, cannot exceed two months. A six-month guarantee on a three-year contract does not fit.

In Catalonia, INCASÒL administers that deposit. The [deposit page](https://incasol.gencat.cat/es/serveis-i-tramits/fiances-de-lloguers/informacio/diposit-de-fiances) says the landlord must pay it in within two months of formalization, under article 3 of Law 13/1996. The procedure is form 2. Anyone required to deal electronically does it online. Delay carries a surcharge under that law. The amount depends on the delay, so I am not copying it from somebody else’s table.

The March decree does not invent a third index. [Decree-law 3/2026](https://www.boe.es/ccaa/dogc/2026/9632/f00001-00027.pdf) amends Law 18/2007 so that it is an infringement to omit, in the advertising or the rental offer, the maximum price from the reference system or, where it applies, the last rent in force in the previous five years; to state a price above the legal one; or to omit that the landlord is a large holder. The same omission in the contract is a separate infringement. The preamble explains the transparency aim. The maximum rent still comes from the LAU, not from a sentence in that preamble.

A listing in a stressed area has to be able to defend the number: the reference report, the last rent of the five years if there was one, and whether the person letting is a large holder under the resolution. The decree enters into force on 26 March 2026, the day after the DOGC. It does not reopen earlier contracts. It does reach advertising and contracts signed after that date. The report that INCASÒL has required since that date is the same paper.

## [What to do when the rental numbers no longer fit](https://pedroochoa.com/en/blog/new-catalonia-rental-regulation-owners-guide-2026/#what-to-do-when-the-rental-numbers-no-longer-fit)

The regulation says which rent you are allowed to write. It does not say whether that apartment, in that building, still makes sense for you.

A new contract in Barcelona, inside the 140, with a low previous rent and five years of minimum extension still ahead, does not look like an unregulated 2018 listing. Outside the two lists, article 17.6 does not apply. A large holder is held to the lower of the previous rent and the index. A small owner with a recent previous rent does not move up to the index to catch up, unless there was no contract in five years and the second paragraph of article 17.7 applies. These declarations activate that paragraph. You do not get the same figure.

I am not signing off on a sale. A contained rent that is actually collected can still make sense. An old rent, with the extension in article 10.3 and a building that needs work, can stop making sense. You see that from the contract, from the last rent that was lodged, and from the report for that dwelling.

This page does not review your clause, count your properties, say whether an extension requested while the decree was in force became settled, or predict the census that comes out of the public information. The check is in the [LAU](https://www.boe.es/buscar/act.php?id=BOE-A-1994-26003) and on the [Generalitat page for stressed areas](https://habitatge.gencat.cat/ca/normativa/zones-de-mercat-residencial-tensionat/). If a DOGC closes the 302 procedure, this paragraph goes stale. The rest does not.

Yes. Barcelona is on the list of 140 municipalities published in the BOE on 15 March 2024, with a term of three years from the day after that publication. The 2026 procedure has not replaced it.

No. As of 21 September 2026 the official page of the Generalitat still treats the extension and the third declaration as public information, not as a resolution that replaces the 2024 resolutions.

Only if the contract agrees to it expressly, on the anniversary, and with written notice. For contracts after 26 May 2023 the INE states that the review uses the IRAV, not a 2 percent cap.

No. Law 11/2025 says that splitting the dwelling does not change the nature of the lease and that the sum of the simultaneous rents cannot exceed the maximum rent of the unitary lease.

Not as a rule in force. Congress repealed it on 28 April 2026 and the decision was published in the BOE of 30 April. This guide does not settle the effect of a request filed while the decree was in force.
